The county determines which Caltrans district claims office takes a claim filed directly with Caltrans. When the State is sued over an injury in California, the proper trial court is in the county where the injury occurred (Government Code section 955.2). On motion, the trial can be moved. The Law Offices of J. Chrisp handles many highway construction zone crash cases.

A claim can go straight to a district office if it is for $12,500 or less and concerns injury or death believed to be caused by Caltrans (Caltrans, Submit Damage Claim). Larger claims, and claims about another state agency, go to the Government Claims Program.
The two arguments below respond to a dangerous condition claim under Government Code section 835. First, a condition is not dangerous if the court decides as a matter of law that its risk was minor, trivial or insignificant (Government Code section 830.2). The court views the evidence most favorably to the injured person and considers the surrounding circumstances. The test is whether any reasonable person would find a substantial risk of injury to careful, foreseeable users.
Second, the entity can avoid liability by proving it acted reasonably (Government Code section 835.4). If an employee created the condition, the question is whether that act or omission was reasonable. If the claim rests on notice, the question is whether the entity’s protective action, or its failure to act, was reasonable. The probability and gravity of potential injury are weighed against the practicability and cost of the alternative. For notice claims, the time and opportunity the entity had to act also count.
Six months after the cause of action accrues is the deadline for presenting a personal injury claim to a public entity (Government Code section 911.2). A late-claim application is possible within a reasonable time, but no later than one year after accrual, and it has to explain the delay (Government Code section 911.4).
Until the claim has been acted on or deemed rejected, no lawsuit for damages may be brought against the entity, subject to statutory exceptions (Government Code section 945.4). After a written rejection notice that meets the statute, the suit is due within six months of personal delivery or mailing. If no such notice is given, it is due within two years after accrual (Government Code section 945.6).

A wrongful death claim may be brought by the person’s surviving spouse, domestic partner, children and issue of deceased children, or by the personal representative on their behalf (Code of Civil Procedure section 377.60). If there is no surviving issue, the people who would inherit by intestate succession may bring it. If they were dependent on the person who died, a putative spouse, children of the putative spouse, stepchildren or parents may also bring it.
