Yes. You can speak with the Law Offices of J. Chrisp before you give any insurer a statement. The consultation is free, the firm works on a contingency fee, and there is no fee unless we win.
The firm’s published results do not include a bicycle case. These are results it has obtained in vehicle crash cases, as shown on chrisplaw.com and its case results page:
Every case is different, and prior results do not guarantee a similar outcome.
Call 911 and ask for police to come to the scene. A driver involved in an injury crash must stop, identify themselves and help anyone hurt (Vehicle Code sections 20001 and 20003).
A person riding a bicycle on a road has all the rights, and is subject to all the rules, that apply to the driver of a vehicle, except rules that by their nature cannot apply to a bicycle (Vehicle Code section 21200).
California uses pure comparative fault, set out by the California Supreme Court in Li v. Yellow Cab Co. (1975). A rider who was partly at fault can still recover, and the compensation is reduced by the rider’s share. If you are found 10% at fault, you can recover 90% of your damages.
When more than one person or company shares fault, each defendant pays non-economic damages, such as pain and suffering, only in proportion to its own share (Civil Code section 1431.2).
| Deadline | What it controls | Source |
|---|---|---|
| 6 months | Written claim against a public entity, such as the City of Napa, Napa County or the state, for an injury. It is due within six months after the claim arises (accrues). A late-claim application is possible within limits. | Government Code section 911.2; section 911.4 |
| 2 years | Most personal injury lawsuits | Code of Civil Procedure section 335.1 |
| 3 years | Damage to the bicycle and other property | Code of Civil Procedure section 338 |
Who writes the crash report depends on where it happened. On Highways 12, 29 and 121 and on unincorporated county roads, it is usually the California Highway Patrol’s Napa Area office, 975 Golden Gate Drive, Napa, CA 94558. Request a CHP report with form CHP 190. Inside the city, collisions on city streets are generally handled by the Napa Police Department, 1539 First Street, Napa, CA 94559.
The Napa Valley Transportation Authority describes the Napa Valley Vine Trail as a walking and biking trail. Its Oak Knoll segment links Napa to Yountville along Solano Avenue.
If a pothole, broken pavement, a trail defect or a public vehicle caused the crash, the claim goes to the agency that owns or runs it, and the six-month claim deadline applies:
Lawsuits over Napa injuries are generally filed in the Superior Court of California, County of Napa, whose civil cases are handled at the Historic Courthouse, 825 Brown Street, Napa, CA 94559.

If you are 18 or older, California law does not require a helmet on a bicycle, so riding without one is not a traffic violation. Talk to a lawyer about how the other side may raise it.
A person may not open a car door on the side of moving traffic unless it is reasonably safe (Vehicle Code section 22517). The person who opened the door may be responsible for your injuries. Any share of fault on your part reduces the recovery rather than barring it.
If you are slower than traffic and a bike lane exists, generally yes, with exceptions for passing, left turns, hazards and right turns (Vehicle Code section 21208).
